The KANASA Foundation

The KANASA Foundation is a Belizean Foundation which exists to help domain registrants ensure their privacy and guard against spam correspondence from third parties. Domain name registrants may transfer their domain names to us and without any cost pursuant to the Terms and Conditions noted below, provided that, the Registrar they have registered their domain name with has created a technical interface with us ("Interfaced Registrar") and the corresponding Registry for their domain name permits the transfer of such domain name to us.

Terms and Conditions

  1. Transfer of Domains - Upon the transfer of a domain to us through an Interfaced Registrar, the KANASA Foundation shall become the sole and exclusive registrant of the transferred domain name ("Transferred Domain"). Notwithstanding anything to the contrary herein, The KANASA Foundation cannot accept transfers of a domain from any resident of Belize.
  2. License Upon Transfer – KANASA Foundation will give a perpetual, unlimited, unrestricted and exclusive license to use a Transferred Domain to any licensee as designated by the transferor or the licensee from time to time, provided that, the licensee acts in accordance with these Terms and Conditions. For the sake of clarity, the license shall permit the licensee of a Transferred Domain to:
    1. Transfer his license to any other person or entity;
    2. Update and manage all technical matters and details;
    3. Transfer to any other registrant or renew the registration; and
    4. Use the Transferred Domain as the licensee sees fit.
    All of the aforementioned activities shall be undertaken exclusively by the licensee through the domain name account portal provided by the Interfaced Registrar of the Transferred Domain. Notwithstanding anything to the contrary herein, the transferor, licensee, and the KANASA Foundation explicitly authorize the Interfaced Registrar of the Transferred Domain to act as their "Designated Agent" (as defined in the ICANN Transfer Policy) to approve each "Change of Registrant" (as defined in the ICANN Transfer Policy) on their behalf. In such a case, the transferor, licensee and the KANASA Foundation explicitly opt out of any 60-day inter-registrar transfer lock that would otherwise be imposed under the ICANN Transfer Policy due to any such "Change of Registrant".
  3. Forwarding of Correspondence – The KANASA Foundation will forward by email all email correspondence received with respect to the Transferred Domain to the designated email address supplied by the licensee to the Interfaced Registrar. The KANASA Foundation will not accept any correspondence regarding a Transferred Domain other than by email and will not forward any correspondence received by any method other than email. The KANASA Foundation is not responsible for any consequences of its failure to forward any correspondence or the recipient's failure to receive or act upon forwarded correspondence. All correspondence is forwarded by automated means and does not employ any human intervention.
  4. Response to Disputes Involving Transferred Domains – Responding to disputes involving Transferred Domains is the sole responsibility of the licensee. The KANASA Foundation will not respond to any dispute regarding a Transferred Domain.
  5. Termination of License Without Notice – The KANASA Foundation may immediately and without notice terminate the license relating to a Transferred Domain and take any and all steps to effectuate the removal of itself as the registrant of a Transferred Domain in the event that the KANASA Foundation determines in its sole discretion that the Transferred Domain is or was being used in a manner that:
    1. Violates any of the laws of Belize;
    2. Promotes or condones hate crimes, terrorism, the torture of persons or animals or child pornography;
    3. Harms or promotes the harm of minors in any way; or
    4. Promotes the transmission of viruses, Trojan Horses, access codes, backdoors, worms, timebombs or any other code, routine, mechanism, device or item that corrupts, damages, impairs, interferes with, intercepts or misappropriates any software, hardware, firmware, network, system, data or personally identifiable information.
  6. Termination of License With Notice - The KANASA Foundation may upon 48 hours of notice by email terminate the license relating to a Transferred Domain and take any and all steps to effectuate the removal of itself as the registrant of a Transferred Domain in the event that the KANASA Foundation determines in its sole discretion that the Transferred Domain is or was being used in a manner that is objectionable.
  7. Disclosure of Transferor or Licensee Personal Details – The KANASA Foundation will only disclose to third parties the personal details of the transferor and/or licensee related to a Transferred Domain in the event the KANASA Foundation in its sole discretion determines that any of Sections 5.a. through 5.d herein have been breached.

    In the event that the KANASA Foundation determines in its sole discretion that Section 6 herein with respect to a Transferred Domain has been breached, the KANASA Foundation will give the licensee 48 hours to remove the KANASA Foundation as the registrant of the Transferred Domain through the Interfaced Registrar account portal. If the licensee removes the KANASA Foundation as the registrant in this time period, the KANASA Foundation will not disclose to third parties the personal details of the transferor or licensee. Should the licensee fail to remove the KANASA Foundation as the registrant within this time period, the KANASA Foundation may disclose the personal details of the transferor and/or licensee to third parties.
  8. Transfer of Assets – Notwithstanding anything to the contrary herein, the KANASA Foundation reserves the right to transfer any Transferred Domain to another party that will deal with Transferred Domains on substantially the same terms and conditions found herein.
  9. Amending these Terms and Conditions – The KANASA Foundation may add to or change these Terms and Conditions at any time, which amendment shall take effect as soon as such amendment is posted to this website and it is the licensee’s responsibility to regularly check this website for the latest Terms and Conditions. The KANASA Foundation is under no obligation to give notice to licensees that the Terms and Conditions herein have been amended. The KANASA Foundation will never amend these Terms and Conditions in a manner that charges for the functions provided by the KANASA Foundation or expropriate from the licensee the benefits of Transferred Domains without a court order pursuant to Section 10 herein.
  10. Court Orders – The KANASA Foundation will comply with a court order from a court of competent jurisdiction in Belize, regardless of any other term or condition herein.
